Email Policy

How We Define Spam

We define spam as the sending of Unsolicited Commercial Email (UCE), Unsolicited Bulk Email (UBE) or Unsolicited Facsimiles (Fax), which is email or facsimile sent to recipients as an advertisement or otherwise, without first obtaining prior confirmed consent to receive these communications from the sender. This can include, but is not limited to, the following:

  • Email Messages
  • Newsgroup postings
  • Windows system messages
  • Pop-up messages (aka "adware" or "spyware" messages)
  • Instant messages (using AOL, MSN, Yahoo or other instant messenger programs)
  • Online chat room advertisements
  • Guestbook or Website Forum postings
  • Facsimile Solicitations

What We Allow and Don't Allow

We will not allow our servers and services to be used for the purposes described above. In order to use our products and services, you must not only abide by all applicable laws and regulations, which include the Can-Spam Act of 2003 and the Telephone Consumer Protection Act, but you must also abide by our own no spam policies. Commercial advertising and/or bulk emails or faxes cannot be sent from our servers, you must obtain proper email hosting to send any type of bulk, newsletter or advertisement digital mailings. The sending of Unsolicited Bulk Email (UBE) from another service provider advertising a web site, email address or utilizing any resource hosted on our servers, is also prohibited.

Zero Tolerance Spam Policy

We take a zero tolerance stance against sending of unsolicited e-mail, bulk emailing, and spam. "Safe lists" and purchased lists will be treated as spam. Any user who sends out spam will have their account terminated with or without notice and a $1.00 charge per spam transmission from our servers will be assessed. Our web hosting is intended to host your website and normal email use, which DOES NOT include bulk or newsletter mailings of any sort. In order to make any type of bulk mailings you are expected to use other mail servers. You have the ability to point your email DNS to other email applications of your choosing for such purposes.

Required Email Use Restrictions:

You will not be permitted to mail any mailing list that from your PRO-Webs hosted mail server. In doing so, this will also be considered spamming/bulk mailing and may result in termination of the offending account. All electronic mailings are required to fully comply with CAN-SPAM Act at all times. Any unsolicited email being sent from our servers will result in immediate suspension or termination of the offending account and a $1.00 charge per unsolicited email sent. We take a zero tolerance stance against sending of unsolicited email and other forms of spam and will cooperate fully with the FTC or other International authority regarding your use upon their qualified request.

Email marketing and other newsletter mailings must be sent through a proper email marketing service, such as MailChimp. User accounts are limited to a threshold of sending 100 emails per hour to help eliminate form hijack spamming and undue mail server load. Our web hosting is not intended to serve as email hosting. Simple email use is only included for your convenience. No bulk mailings of any kind are permitted.

Sites advertised via SPAM (Spamvertised) may not be hosted on our servers. This provision includes, but is not limited to SPAM sent via fax, email, instant messaging, or usenet/newsgroups. No organization or entity listed in the ROKSO may be hosted on our servers. Any account which results in our IP space being blacklisted will be immediately suspended and/or terminated.

PRO-Webs, Inc. reserves the right to require changes or disable as necessary any web site, account, database, or other component that does not comply with its established policies, or to make any such modifications in an emergency at its sole discretion.

PRO-Webs, Inc. reserves the right to charge the holder of the account used to send any unsolicited e-mail a clean up fee or any charges incurred for blacklist removal. This cost of the clean up fee is entirely at the discretion of PRO-Webs, Inc.

You may not use the PRO Webs, Inc. network, equipment or hosted domain email address to transmit spam, flames, mail bombs, unsolicited email messages, or any similar electronic communication. Your domain or IP address may not be referenced as originator, intermediary, or reply to address in any of the above. This policy extends to the transmission of any unsolicited mailings from another service that in any way implicates the use of the domain hosted with PRO Webs, Inc.

If you are found to have violated the spam policy, PRO Webs, Inc. reserves the right to suspend or terminate your hosting account without warning, as well as assess spam fees at $1.00 per unsolicited email sent. PRO Webs, Inc. accesses a $50.00 USD reactivation fee any suspended domain or account, resulting from a policy or terms violation. Additionally, you will be held financially responsible for the un-blacklisting of your sites IP address, as the IP Block belongs solely to PRO Webs, Inc. and resides on our dedicated servers. Failure to pay for the ISP reputation and blacklist removal can result in legal action on our part to recoup the loss and cost of damages.
